These Terms of Service ("Terms") govern your access to and use of Blackfyre GovCon AI ("Blackfyre," "we," "us," or "our"), a subscription service operated by Blackfyre LLC, Washington, DC. By creating an account or using the service, you agree to these Terms.
Blackfyre provides an AI-powered agent for federal government contracting professionals. The agent assists with business development, capture management, proposal development, and pricing research. It pulls intelligence from third-party procurement data sources including SAM.gov, USASpending, HigherGov, and Tango, and generates responses using the Anthropic Claude API.
The service is accessed via web chat at blackfyre.ai and optionally via Telegram, Discord, or Slack integrations. Community workspace access via Slack is included with all active subscriptions.
$99 per month — includes all features, all channels, and community access. A 3-day free trial is available to new subscribers. A valid payment method is required at signup; you will not be charged until the trial period ends.
You may cancel your subscription at any time from the billing page. Cancellation takes effect at the end of the current billing period — you retain access until then.
Conversations with your agent are processed via the Anthropic Claude API. By using the service, you acknowledge that your messages are transmitted to Anthropic's infrastructure for response generation. Anthropic's privacy policy governs their handling of this data. Blackfyre has configured Claude API usage under a zero data retention agreement — Anthropic does not use your conversations to train models.
AI-generated responses are informational and do not constitute legal, financial, or procurement advice. You are responsible for verifying all solicitation details, pricing figures, and compliance requirements independently before submission.

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.
Your company profile, conversation history, and usage data are stored on Supabase (AWS infrastructure) with row-level security. No other subscriber can access your data. For full details, see our Privacy Policy and Data Processing Agreement.
You retain ownership of all content you input into the service. You grant Blackfyre a limited license to process your inputs solely to provide the service. Outputs generated by the agent are provided for your use; you are responsible for reviewing them before use in proposals or submissions.
The Blackfyre name, logo, design system, and underlying software are owned by Blackfyre LLC. Nothing in these Terms grants you rights to our intellectual property.
To the maximum extent permitted by applicable law, Blackfyre and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.
Our total aggregate liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the three months preceding the claim.
The service is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or that the intelligence data it surfaces will be complete or current. Procurement data is sourced from third-party APIs and may not reflect the most recent updates on source systems.
These Terms are governed by the laws of the District of Columbia, United States. Any disputes shall be resolved in the federal or state courts located in Washington, DC.
We may update these Terms at any time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
